This portal has been created to handle business interruption claims from Hiscox customers. Please follow the questions providing the information requested.
At this stage in the portal you can register your claim and we will review your claim against your policy.
We will need to establish whether you had business interruption cover at the relevant date(s) and whether you meet the eligibility criteria for loss assessment and payment.
We will only ask you to proceed through to the next stage in the portal and provide the financial information necessary to calculate any loss payable to you if we have established that your policy responds to your claim.
In June 2020, the Financial Conduct Authority (FCA) commenced High Court proceedings to seek clarity about the application of certain non-damage business interruption policy wordings.
On 15 January 2021 the Supreme Court published its Judgment in these court proceedings. The Supreme Court confirmed that, subject to policy terms and conditions, cover is available to those businesses that were subject to compulsory closure.
This includes businesses such as restaurants and bars; leisure facilities and gyms; hair and beauty salons and non-essential retail shops.
The Supreme Court made clear that it would be difficult and rare for a business not subject to compulsory closure to establish a covered claim.
A summary of the FCA Test Case and information about business interruption claims is available on the FCA’s website. (https://www.fca.org.uk/firms/business-interruption-insurance).
Guidance and explanations are provided to help you complete all of the questions as you progress through the portal. Contact details are also provided if there are any specific queries about the portal and the questions we are asking.
The first part of the portal should take around five minutes to complete and you will need to have the following information ready:
- Information about your company, such as company number/sole trader name
- Contact details for your insurance broker (if you bought your policy through a broker).
- The time period during which any mandatory government restrictions caused an interruption to your business, including the start and (where applicable) end dates of those mandatory government restrictions
- Any significant changes you have made to your business activities following the relevant government regulations imposing your business closure.
